TERMS AND CONDITIONS FOR THE USE OF THE POWER UP PROGRAM
The Power Up program, including the website, training programs, guides, manuals, fact sheets and the information they contain on any subject and on all pages, in whole, in part, or in combination (the “Program”), are the property of the Fondation Tremplin Santé, which also operates the Program. The Program and the information contained therein are made available to you subject to your agreement to be bound by these terms and conditions of use (“Terms and Conditions”), as well as all applicable laws.
By using the Program, you agree to be bound by these Terms and Conditions. If you are not willing to accept these Terms and Conditions, you must immediately stop using the Program and notify the Fondation Tremplin Santé that you are cancelling your membership.
The Fondation Tremplin Santé reserves the right to modify these Terms and Conditions at any time by sending you notice to that effect and, by continuing to use the Program after such modifications, you indicate your acceptance of these Terms and Conditions as modified. It is your responsibility to review these Terms and Conditions regularly.
Use of the Power Up program
Unless otherwise indicated, the Program and the information contained therein are made available to you solely for non-commercial purposes. You cannot reproduce the Program or any information it contains, in whole or in part, for any other purposes than those cited in the previous sentence. Any other special terms and conditions stated elsewhere on the website regarding the use of certain information provided on the site shall be included in these Terms and Conditions and form part of them. You acquire no rights or licences to the Program or the information it contains other than the limited right to use the Program and the information therein in accordance with these Terms and Conditions. Unless as expressly provided for in these Terms and Conditions, any copying, retransmission, distribution, republication, modification, translation or sale of the information contained in the Program, in whole or in part, or any copying, retransmission, republication, distribution, modification, decompilation, manipulation, reverse engineering, or other exploitation of the Program without the prior written permission of the Fondation Tremplin Santé is strictly prohibited. TheFondation Tremplin Santé reserves the right to take such steps that it deems necessary, including legal action, to terminate any unauthorized or prohibited activity, and the Fondation Tremplin Santé also reserves the right to immediately suspend or terminate all access to the Program, without prior notice and at its sole discretion.
Trademarks, copyright and intellectual property
Unless otherwise indicated, all logos, names, designs, service marks and trademarks displayed in the Program or in the materials or information it contains are trademarks, trade names or service marks of the Fondation Tremplin Santé. Nothing in this agreement shall be construed as conferring, by implication or otherwise, a license or right to use a logo, name, design, service mark, trademark or other intellectual property right of the Fondation Tremplin Santé. Any unauthorized or prohibited use of the trademarks, trade names or service marks of the Fondation Tremplin Santé is strictly prohibited.
The Program, and the images, audio elements, video elements and information it contains are protected by copyright or trademark law, or are otherwise protected and owned by the Fondation Tremplin Santé. Any copy, retransmission, distribution, republication, modification, translation or further dissemination of the information contained in the Program is prohibited without the prior written consent of the Fondation Tremplin Santé. Except as expressly provided for in this agreement, nothing contained in said agreement shall be construed as conferring any licence or right under any copyright of the Fondation Tremplin Santé.
Compliance with laws
In addition to complying with these Terms and Conditions, you agree to use the website and the materials and information it contains for lawful purposes only and in a manner consistent in all ways with all applicable municipal, national or international laws and regulations.
Information concerning users of the Program
Subject to policies on the privacy and security of personal information, in the event that you provide, electronically or through your access to or use of the website, any information, including feedback data such as questions, comments, suggestions or other statements concerning any information contained in this Program, such information provided by you shall be deemed to be non-confidential and the Fondation Tremplin Santé shall incur no obligation of any kind concerning said information and shall be free to reproduce, use, disclose and distribute such information to others without limitation.
In addition, the Fondation Tremplin Santé shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products incorporating such information. You also warrant that all information that you provide electronically or through your access to or use of the website, including any ideas, concepts, know-how or techniques contained in such information, does not infringe on the intellectual property rights of any third party whatsoever.
The Terms and Conditions of the Program shall be governed by the laws of the province of Quebec and the laws of Canada applicable in the province of Quebec.
